Commissioners,

 

Staff prepared a draft interlocal agreement for providing Code Enforcement Services to the City of Hawthorne based on the last discussion with the County Commission, attached.  As you may recall, since the other cities had decided to continue providing their own code enforcement, we were proposing to handle enforcement for Hawthorne with current staff and monitor the workload.  The interlocal included a $70 fee for each site visit for code issues.  If no violations were found on the property or if the property owner complied after either discussion with the code officer or in response to a Notice of Violation, the $70 fee was to be charged to the City of Hawthorne. If the property owner did not comply and the code violation ended up at the Magistrate, all costs would be charged to the property owner and the City would not be billed.  Any fees paid as a result of the Magistrate hearings would accrue to the County to compensate for staff and Magistrate time. 

 

Staff sent this draft interlocal for review to the City of Hawthorne Attorney and City Manager.  They placed the discussion on a city agenda last week. Greta Moreau, Interim Code Director, attended the meeting to respond to questions.  The City Commissioners stated that they wanted amendments to the draft interlocal and to table the discussion until the joint meeting with the County on April 30th. The changes requested were:

 

  1. An addition to the Interlocal agreement that the County will not foreclose on any property in the City.

 

2.  They do not agree to the $70 fee.
