Good afternoon commissioner’s-

I’m writing you in hopes that you can provide guidance on how to handle and seek remediation of an issue we are having on our farm due to our neighbors storm water.

For the last several years we’ve been communicating with the school next door (Saint Francis) that there is excessive storm
Water entering our property from their property lines. We own a 20 acre farm next door and 3-4 acres are currently underwater. To some it may not seem like much but this is where we house our livestock and where they graze as it’s the only place we consistently have forage. After multiple communications with the principal at Saint Francis over the last few weeks- there has been no action taken to resolve the issue before the storm. Our property was already holding its max capacity of water from previous rains but the storm today pushed it over the top. We had to evacuate our livestock, build temporary pens, supplement feed since our pasture is underwater and now the water has not only hindered my property but our two neighbors.

I went to the school today and sourced two major areas of concern that need to be addressed. I was told the retention pond is holding water and maintained- upon my observation today- the retention pond was not holding water nor maintained- instead was filling through the box and heavily flowing down to our pasture. Another area is a pond where there are no berms and the water flower is directed into a made crevice that flows into our property. I was able to capture videos and photos of what I observed in hopes it would shed light on where the water is originating from. We have lost crops, animals, money and our pride over this battle. We have built berms, added rocks and trees to help but the water flow is so heavy that nothing will hold.

Im hoping you can help us figure out a solution or point us in the right direction.

I’m attaching some of the footage from our farm. This is only one area- we have three separate areas of water encroachment.
